🌴 Earned Leave (EL) – Complete Rules
Earned Leave is the most valuable leave type for Central Government employees. It accrues at 30 days per year (15 on January 1 and 15 on July 1) for non-vacation department employees and can be accumulated up to a maximum of 300 days.
| Feature | Non-Vacation Dept | Vacation Dept (Schools/Courts) |
|---|---|---|
| Annual Accrual | 30 days (15 on Jan 1 + 15 on Jul 1) | 15 days (only if vacation < 75 days) or 8 days |
| Max Accumulation | 300 days | 300 days |
| Advance Credit | 15 days credited in advance on Jan 1 & Jul 1 | Proportionate to vacation availed |
| Max at a Stretch | 180 days (extendable for prolonged illness) | Same |
| Leave Salary | Full pay + DA + HRA + TA | Same |
| Encashment on Retirement | Up to 300 days – 100% tax-free | Same |
| Encashment on LTC | Up to 10 days per LTC, 60 days career max | Same |
| Lapse on Resignation | Earned leave lapses; no encashment unless retirement | Same |
| During Probation | Accrues from date of appointment, available after confirmation | Same |
EL Deduction on Joining: When an employee joins a new post after a transfer, the EL balance is carried forward from the old post — there is no deduction. EL balance survives transfers, inter-departmental movements, and promotions. It only lapses when an employee resigns (not retires), is dismissed, or removed from service.
🏥 Half Pay Leave (HPL) & Commuted Leave
Half Pay Leave accrues at 20 days per year (10 on January 1 and 10 on July 1) and has no maximum accumulation limit. It can be availed with or without a Medical Certificate (MC), but leave beyond 30 days requires an MC. Two HPL days can be commuted into one Commuted Leave day at full pay.
Commuted Leave
2 HPL = 1 Full Pay Day
Commuted leave converts HPL to full pay. Maximum 180 days (with MC) or 90 days (without MC) in entire career. The HPL account is debited 2 days for every 1 commuted leave day. If the employee quits within 3 years, the commuted leave is converted back to HPL and recovery is made.
Without Medical Certificate
Up to 30 Days Without MC
HPL up to 30 days can be availed without a Medical Certificate for personal reasons. Beyond 30 days, a Medical Certificate from an Authorised Medical Attendant (AMA) is mandatory. The certificate must specify the nature of illness and the period of incapacity for duty.
Leave Salary
Half Pay (Basic/2 + DA)
Leave salary during HPL is calculated as: Basic Pay/2 + Dearness Allowance on half basic + HRA on half basic. TA is not admissible during HPL. NPS contribution (employee share only) continues to be deducted during HPL.
Leave Not Due
Advance Against Future HPL
Leave Not Due (Rule 31) allows an employee to take leave in advance against future HPL earnings. Maximum 360 days in career (with MC) or 180 days without MC. The leave is debited to a negative balance which must be offset by future HPL accruals. Recovery is made if the employee fails to earn enough HPL before retirement.
👶 Child Care Leave (CCL) – Rule 43C
CCL is available to female Central Government employees and single male employees (widowers/divorced) for a total of 730 days in the entire career for taking care of up to 2 children up to the age of 18 years (no age limit for disabled children). The leave salary is 100% for the first 365 days and 80% for the remaining 365 days.
Eligibility
Female + Single Male Parents
Female employees with up to 2 children under 18 years. Single male employees (widowers or those with judicial separation) also qualify since the DoPT amendment. A “single male” must produce documentary evidence (death certificate of spouse or court order).
Minimum Spell
Minimum 5 Days Per Spell
CCL cannot be taken for less than 5 days at a time. It may be availed in a maximum of 3 spells in a calendar year. CCL cannot be combined with casual leave — but can be combined with EL, HPL, Maternity Leave, and other formal leave types.
Leave Salary Rates
100% / 80% Split
First 365 days of CCL in entire career: 100% of (Basic+DA). Next 365 days: 80% of (Basic+DA). HRA continues during CCL. TA is not admissible. The 365/365 split is counted cumulatively across the entire career — not per year.
Counts for Increment?
Yes – Treated as Duty
CCL is treated as duty for all service purposes — it counts for annual increment, promotion, MACP, and qualifying service for pension. This is unlike EOL which does not count. The employee’s DNI (increment cycle) is not affected by CCL.
Disabled Children
No Age Limit for Disabled Child
For children who are physically or mentally disabled (as certified by a government medical board), CCL can be availed without the 18-year age restriction. The same 730-day career limit applies.
Not Admissible
Cannot Replace Maternity Leave
CCL cannot be used as a substitute for Maternity Leave. It is also not admissible during the last year before retirement for purposes of leave encashment planning. CCL is not encashable — unlike EL, unused CCL does not carry any monetary value on retirement.
🤱 Maternity & Paternity Leave

Tubectomy / Family Planning Leave: An additional 14 days of special casual leave is admissible to female employees who undergo tubectomy or vasectomy (male employees: 6 days). This is separate from Maternity Leave and does not affect the leave account.
☀️ Casual Leave & Special Casual Leave
Casual Leave is not a formal leave under CCS Leave Rules 1972 — it is governed by departmental office instructions. It cannot be combined with any formal leave (EL, HPL, etc.) but can be prefixed or suffixed with public holidays and Sundays.
Regular CL
8 Days Per Calendar Year
8 days of casual leave per year. Maximum 3 consecutive days at a time (exceptionally up to 5 with Restricted Holidays). CL does not carry forward to next year — it lapses on December 31. Half-day CL is permissible (pre-lunch / post-lunch).
Special Casual Leave
For Specific Official Purposes
Special Casual Leave (SCL) is granted for: sports events, cultural activities, mountaineering/trekking expeditions, union activities, election duties, natural calamities, and blood donation (1 day per donation, max 4 per year). Up to 10 days SCL per year for differently-abled employees.
Restricted Holidays
2 RH Per Year
Each employee is entitled to 2 Restricted Holidays (RH) per year from the list of 14–16 RHs notified. An RH can be prefixed or suffixed to CL or a public holiday. If an RH falls on a Sunday or public holiday, no substitute is given.
Gazetted Holidays
17 National/Festival Holidays
Central government employees get 3 National Holidays (Republic Day, Independence Day, Gandhi Jayanti) plus approximately 14 gazetted holidays per year. These are compulsory paid holidays — no leave is consumed. The total holidays (including Sundays) amount to 80–90 non-working days per year.
🚫 Extra Ordinary Leave (EOL) – No Pay Leave
EOL under Rule 32 is granted when no other leave is available or when specifically requested by the employee. It carries nil leave salary — the employee draws no pay during EOL. It also does not count for annual increment or qualifying service for pension.
With Medical Certificate
Counts for Increment & Pension
If EOL is taken on the basis of a Medical Certificate from an Authorised Medical Attendant (AMA), it is treated as qualifying service for increment purposes only. It still does not count for pension qualifying service unless specifically regularised by the competent authority.
Max Duration
No Fixed Cap (Usually Up to 5 Years)
There is no statutory maximum period for EOL under CCS Leave Rules. However, the competent authority may not grant EOL beyond 5 years continuously. Prolonged EOL beyond 5 years may be treated as abandonment of service or may lead to termination proceedings.
No Pay Period
Nil Leave Salary
During EOL, the employee draws no pay whatsoever — Basic Pay, DA, HRA, TA are all stopped. NPS contribution is also suspended. The employee’s service record shows a “break” during EOL which must be regularised. HRA accommodation must be vacated if EOL exceeds specified limits.
💰 Leave Encashment on Retirement – Rule 39
Central Government employees can encash up to 300 days of Earned Leave at the time of retirement. The encashment is fully exempt from income tax under Section 10(10AA)(i) of the Income Tax Act, with no monetary ceiling for government employees.
| Feature | Details |
|---|---|
| Maximum EL Encashable | 300 days |
| Formula | (Basic Pay + DA) × EL days ÷ 30 |
| Tax Exemption | 100% exempt under Section 10(10AA)(i) – no ceiling for govt. employees |
| Private Sector Limit | ₹25,00,000 maximum exemption (revised from ₹3 lakh) |
| On Superannuation | Full 300 days encashable |
| On Voluntary Retirement (VRS) | Full 300 days encashable |
| On Dismissal / Removal | Not admissible |
| On Death in Service | Full encashment paid to family/nominee |
| On Resignation | Not admissible (EL lapses) |
| During Service Encashment (LTC) | Taxable as salary income |
| HPL Encashable? | No – only EL is encashable |
Encashment Calculation Example: Basic Pay ₹78,800 + DA at 55% = ₹40,876 + Basic = ₹1,19,676/month. Daily rate = ₹1,19,676 ÷ 30 = ₹3,989. EL balance 280 days. Encashment = 280 × ₹3,989 = ₹11,16,920 — fully tax-free on retirement.
✈️ LTC Leave Encashment – 10 Days Rule
While availing Leave Travel Concession (LTC), a Central Government employee can encash up to 10 days of EL per LTC journey, subject to a career maximum of 60 days total. This encashment amount is taxable as salary income during service.
Per LTC Journey
Up to 10 Days EL
Maximum 10 days of EL can be encashed on each LTC occasion. The employee must actually avail the LTC journey — encashment without travel is not permitted. Both Home Town and All-India LTC qualify.
Career Cap
Maximum 60 Days in Career
The cumulative total of EL encashed via LTC cannot exceed 60 days in the entire career. This is separate from the retirement encashment limit of 300 days. The 60 LTC-encashed days are deducted from the 300-day retirement pool.
Tax Treatment
Fully Taxable During Service
Unlike retirement encashment (100% tax-free), LTC encashment during service is fully taxable as salary. No exemption is available under Section 10(10AA) for in-service encashment. Relief under Section 89 (Form 10E) may be claimed if it causes higher tax for that year.
Formula
(Basic + DA) ÷ 30 × Days
LTC encashment = (Basic Pay + Dearness Allowance) ÷ 30 × number of EL days encashed. HRA and TA are not included in the encashment calculation. The encashment is processed through the DDO along with the LTC bill.
🔗 Combining Leaves – Permissible Combinations
| Leave Type | Can Combine With | Cannot Combine With | Notes |
|---|---|---|---|
| EL | HPL, Commuted, CCL, Maternity, Paternity, Study, EOL | Casual Leave | Most flexible – can be prefixed/suffixed with holidays |
| HPL | EL, Commuted, EOL, Maternity | Casual Leave, CCL | MCertificate required beyond 30 days |
| Commuted Leave | EL, HPL, EOL | CCL, Casual Leave | Debits HPL account at 2:1 ratio |
| CCL | EL, Maternity, Paternity | HPL, Casual Leave, Commuted | Minimum 5 days; max 3 spells/year |
| Maternity Leave | EL, HPL, CCL, Paternity | Casual Leave | Can be prefixed/suffixed with EL |
| Paternity Leave | Any formal leave including Maternity | Casual Leave | Must be within window of 15 days before to 6 months after delivery |
| Casual Leave | Restricted Holidays, Public Holidays, Sundays (prefix/suffix) | ALL formal leave types (EL, HPL, CCL, etc.) | Cannot be combined with any leave under CCS Leave Rules |
| EOL | EL, HPL, Commuted Leave | CCL, Maternity, Casual Leave | Only after all other leave is exhausted |
| Study Leave | EL (prefix/suffix only) | HPL, CCL, Casual Leave | Cannot be combined concurrently; only adjoining |
Holidays in Leave Period: If a public holiday or Sunday falls during a period of formal leave (EL, HPL, Maternity, etc.), it is counted as part of the leave and the leave account is debited accordingly. The holiday does not break the leave spell or provide a free day. However, holidays prefixed or suffixed to leave are not counted as leave days — the leave begins only on the first working day after the holiday.

══ FAQ ══
Frequently Asked Questions
Common queries on leave rules for Central Government employees
How is Earned Leave accrual calculated and when does it credit?▾
Earned Leave accrues at 30 days per year — 15 days credited on January 1 and 15 days on July 1 of each year, in advance. If an employee joins mid-year, the credit for that half-year is prorated: 5/3 days per completed calendar month. For example, joining on 1 March means 4 completed months (March–June) → 4 × 5/3 = 6.67 → 6 days credited on July 1 of that year. The maximum accumulation is 300 days — any excess beyond 300 days is automatically lapsed at the end of each half-year.
How much leave encashment will I get on retirement with 280 EL days?▾
Leave encashment at retirement is calculated as: (Basic Pay + DA) ÷ 30 × EL days. For example, with Basic Pay ₹56,100 and DA at 55% (₹30,855), total = ₹86,955. Daily rate = ₹86,955 ÷ 30 = ₹2,899. With 280 days of EL: 280 × ₹2,899 = ₹8,11,600. This entire amount is 100% exempt from income tax under Section 10(10AA)(i) of the Income Tax Act for Central Government employees — there is no monetary ceiling (unlike private sector where it is capped at ₹25 lakh).
Can a male government employee take Child Care Leave?▾
Yes — but only single male employees (widowers or those legally separated from their spouse) are entitled to Child Care Leave under Rule 43C. Regular married male employees with a living spouse are not eligible for CCL. Single male employees must submit documentary proof of being single (spouse’s death certificate or court order for judicial separation). All other CCL rules apply equally — 730 days career limit, 100%/80% pay split, 5-day minimum per spell, maximum 3 spells per year, applicable for children up to 18 years (or disabled children of any age).
What is the difference between Commuted Leave and Half Pay Leave?▾
Half Pay Leave (HPL) is availed at half pay — you draw 50% of your normal salary during this period. Commuted Leave is HPL converted to full pay — your leave account is debited 2 HPL days for every 1 working day, but you draw full salary. So commuted leave gives you full pay at the cost of using up HPL at a 2:1 ratio. Maximum commuted leave is 180 days (with Medical Certificate) or 90 days (without MC) in the entire career. If you resign or quit within 3 years of taking commuted leave, the leave is converted back to HPL and recovery is made from your dues.
Does Casual Leave lapse if not used by December 31?▾
Yes — Casual Leave does not carry forward to the next calendar year. Any unused CL as on December 31 lapses permanently. Casual Leave is an annual entitlement — 8 days per year — governed not by the CCS Leave Rules 1972 but by departmental office instructions. It must be taken within the calendar year.
It cannot be combined with any formal leave type. CL also cannot be encashed — neither during service nor at retirement. Half-day CL is permissible (either first half or second half of the day). Restricted Holidays (2 per year from the 14–16 RH list) are separate from CL and do not lapse the same way — unused RH from the first half of the year lapses by June 30, and second half by December 31.
Can I combine Earned Leave with Maternity Leave?▾
Yes — Earned Leave can be prefixed or suffixed to Maternity Leave, or combined simultaneously. An employee expecting a delivery can prefix EL (say 30 days) before the Maternity Leave period begins, and then suffix EL or CCL after the 180-day Maternity Leave ends. There is no restriction on the quantum of EL that can be combined with Maternity Leave. However, Casual Leave cannot be combined with Maternity Leave or any formal leave. Total leave duration including EL prefix/suffix and Maternity Leave can extend to 9–12 months, giving adequate time for recovery and childcare.
Is leave salary paid during Study Leave, and is the service period counted?▾
Study Leave under Rule 50 carries leave salary as follows: (a) For study in India — the employee draws a study allowance or leave salary at a rate prescribed by the government (typically equivalent to HPL rate or as per the study leave order); (b) For study abroad — the employee draws 3/4 of the emoluments they would have drawn on duty. Study Leave counts as qualifying service for pension — it does not break the service record. The employee must execute a bond to serve for at least 3 years after returning. Study Leave can be availed only after completing 5 years of regular service and requires the Director/Secretary-level authority’s approval. Maximum 24 months in career (12 months at a stretch).
What happens to leave balance when transferred to another department?▾
When a Central Government employee is transferred from one department/ministry to another, the entire leave balance is carried forward — EL, HPL, CCL balance — all transfer to the new department. There is no lapse or forfeiture on transfer. The new department must accept the leave balance as per the last service certificate issued by the outgoing department. This also applies to inter-cadre transfers, promotions to higher grades, and absorption into autonomous bodies (with some conditions). The only case where EL lapses is on resignation from service — where the employee forfeits all accumulated leave balance without any encashment.
Can Extra Ordinary Leave (EOL) affect my pension qualifying service?▾
Yes — EOL without Medical Certificate does not count as qualifying service for pension. If you took 12 months of EOL without an MC, your qualifying service for pension is reduced by 12 months. This can push you below the required qualifying service threshold and directly reduce your pension amount. EOL with Medical Certificate from an Authorised Medical Attendant counts for increment purposes but still generally does not count for pension qualifying service unless the competent authority specifically regularises the period as duty. To protect pension entitlement, always try to avail EL, HPL, or Commuted Leave before resorting to EOL. Extended EOL also does not count for MACP (Modified Assured Career Progression) timelines.
